Agreement to Terms

By accessing or using the AruPet website, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions, then you may not access the website or use any services.

Description of Service

AruPet provides an online marketplace connecting buyers and sellers of Mithun cattle in Arunachal Pradesh for the sole purpose of taming only. Our platform facilitates the listing, discovery, and purchase of Mithun cattle.

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our platform.

User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account and password.
  • Restricting access to your computer and account.
  • Accepting responsibility for all activities that occur under your account or password.
  • Ensuring that information you provide about Mithun cattle for sale is accurate and truthful.

Intellectual Property

The AruPet name and logo are trademarks owned by AruPet and are protected by applicable trademark laws. Unauthorized use of our trademark is prohibited without our express written permission.

Limitation of Liability

In no event shall AruPet, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Arunachal Pradesh State, India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located within Arunachal Pradesh State.

Shipping Policy

Shipping Methods and Timeframes

Due to the nature of our products (live Mithun cattle), our shipping policy works differently than traditional e-commerce:

  • Transportation of purchased Mithun cattle is the responsibility of the buyer.
  • Buyers have 4 days from purchase confirmation to arrange and complete pickup/transportation.
  • AruPet can provide recommendations for transporters experienced in livestock handling if needed, but all arrangements must be made by the buyer.

Post-Period Charges

If the buyer fails to pick up the Mithun cattle within the 4-day timeframe:

  • A post-period charge of ₹500 per day will apply for each day beyond the 4-day window.
  • This charge is payable directly to the seller for continued care and maintenance of the animal(s).
  • Buyers will need to settle these charges with the seller before taking possession of the animal(s).

Transportation Care Guidelines

When arranging transportation, buyers should ensure:

  • Vehicles are suitably equipped for livestock transportation.
  • Animals are provided with adequate food and water during transit.
  • Transportation complies with all applicable animal welfare regulations.

AruPet provides general guidance on proper transportation methods but cannot be held responsible for the transportation process.

Delivery Confirmation

Upon taking possession of the animal(s):

  • Buyers must inspect the animals thoroughly at the pickup location.
  • Buyers must verify the condition and health of the animals before transportation.
  • Any concerns must be raised immediately with the seller and reported to AruPet customer service.
  • Important: Once the buyer completes inspection and takes possession of the cattle, no returns will be accepted for any reason.

Return and Refund Policy

Inspection Period

Upon pickup of Mithun cattle:

  • Buyers must thoroughly inspect the animals at the pickup location before taking possession.
  • Any issues must be documented and reported to the seller and AruPet customer service immediately, before taking possession.
  • Once the buyer takes possession of the cattle after inspection, no returns or refunds will be accepted for any reason.

Return Conditions

Returns may be accepted only before the buyer takes possession, under the following conditions:

  • The animal has a verifiable health issue not disclosed in the listing.
  • The animal's characteristics (age, sex, breed) significantly differ from what was advertised.
  • The animal shows signs of disease or distress not apparent in the listing.

Return Process

If a return is approved (only possible before taking possession):

  • AruPet will coordinate the return/cancellation process.
  • A veterinarian examination may be required to verify the claimed issues.

Refund Process

For approved returns:

  • Full refunds by the seller must/will be processed within 2-4 business days after the return/cancellation.
  • Partial refunds may be offered in cases where issues are minor but impact value.
  • Refunds will be issued to the original payment method used for the purchase.

Non-Refundable Fees

In certain circumstances, some fees will not be refundable:

  • The booking amount and the platform fee is non-refundable if the buyer fails to collect the purchased Mithun within four (4) days from the location specified by the seller.
  • This policy aligns with our shipping policy's 4-day pickup timeframe.
  • The non-refundable status applies regardless of the reason for the delay in collection.

Refund Due to Seller Non-Compliance

If the seller does not fulfill their obligations:

  • In cases where the seller refuses to make the Mithun available for pickup as agreed, the booking amount and the platform fee will be fully refunded to the buyer.
  • AruPet will initiate the refund process within 2 working days of confirming seller non-compliance.
  • Buyers must provide evidence of attempted collection and seller refusal.

Dispute Resolution

Regarding disputes between buyers and sellers:

  • AruPet is not responsible for resolving disputes arising between the seller and buyer during the purchase process.
  • Buyers and sellers are encouraged to communicate directly to resolve issues amicably.
  • However, in clear cases of non-compliance by the seller (such as refusal to make the Mithun available), refunds for the booking amount and the platform fee will be processed as described above.
  • AruPet reserves the right to investigate claims before processing refunds.

Exceptions

Returns are not accepted in the following cases:

  • After the buyer has taken possession of the animal(s), regardless of timeframe or reason.
  • For issues arising from improper handling or care after pickup.
  • For subjective preferences that were not part of the listing specifications.

Payment Policy

Accepted Payment Methods

AruPet accepts the following payment methods:

  • Credit/Debit Cards (Visa, MasterCard, RuPay).
  • UPI Payments.
  • Net Banking.
  • Bank Transfers.
  • Cash on Delivery (for certain locations and orders below a certain value).

Two-Phase Payment Structure

Due to the nature of Mithun cattle purchases, we implement a two-phase payment structure:

  • Initial Payment: At the time of order confirmation through our website, you must pay: Booking Amount: 10% + Platform Fee: 5%.
  • Final Payment: 90% of the total purchase price, paid upon inspection and acceptance of the animal(s) directly to the seller.

Platform Fee

A 5% platform fee applies to all purchases on AruPet:

  • This fee is calculated based on the seller's listed price.
  • The platform fee is charged in addition to the seller's price (not included in the listed price).
  • The fee is collected at the time of booking along with the 10% booking amount.

Payment Security

All payment information is encrypted and processed securely. AruPet does not store credit card details on our servers. All transactions are processed through secure payment gateways that comply with PCI DSS standards.

Invoicing

Digital invoices will be provided for all transactions and will include:

  • Mithun cattle details (age, gender, identification number if available).
  • Seller's listed price.
  • Booking amount (10% of seller's price paid through website).
  • Platform fee (5% of seller's price, paid through website).
  • Remaining amount to be paid directly to seller (90% of seller's price).
  • Total amount payable (seller's price + platform fee).

Taxes

Live animals, including Mithun cattle, are exempt from GST (Goods and Services Tax) in India under Chapter 1 of the HSN code classification.

Cancellation Policy

Order Cancellation by Buyer

Buyers may cancel an order under the following conditions:

  • Within 2 hours of placing the order: 100% refund of booking amount (platform fee is non-refundable).
  • Between 2-12 hours: 75% refund of booking amount (platform fee is non-refundable).
  • Between 12-24 hours: 50% refund of booking amount (platform fee is non-refundable).
  • After 24 hours but before shipping: 25% refund of booking amount (platform fee is non-refundable).
  • After shipping has begun: No refund of booking amount or platform fee.

Order Cancellation by Seller

If a seller cancels an order for any reason:

  • Buyer receives 100% refund of the booking amount.
  • The platform fee will also be refunded.
  • Repeated cancellations by sellers may result in penalties or account suspension.

Order Cancellation by AruPet

AruPet may cancel orders in the following circumstances:

  • Suspected fraudulent activity.
  • Verification issues with buyer or seller information.
  • Animal welfare concerns.
  • Force majeure events (natural disasters, civil unrest, etc.).

In such cases:

  • A full refund of the booking amount and the platform fee will be provided to the buyer.
  • In exceptional circumstances where AruPet cancels due to system errors or administrative issues, both the booking amount and platform fee may be refunded at AruPet's discretion.
  • In all other cases, the platform fee remains non-refundable.

How to Cancel an Order

To cancel an order:

  • Log in to your AruPet account.
  • Navigate to "My Orders".
  • Select the order you wish to cancel.
  • Click on "Cancel Order" and follow the instructions.
  • Alternatively, contact our customer support team.
